The Directors Education Series: IRA SECURE Act and Legislative Update

With all the substantial changes to IRA in the past 2 years, it is hard to keep up with the new rules, revised rules and the pending legislation. One of the greatest disadvantages to IRAs when the SECURE Act was signed into law in December 2019 was the accelerated beneficiary payout option. Since 2002, most beneficiaries were able to take IRA distributions based on their age from the Single Life Expectancy Table resulting in 30-40 years of distributions - depending on how young they were. Effective for owners dying beginning in 2020, most nonspouse beneficiaries are shortened to a 10-year payout method, which may result in beneficiaries taking larger distributions that will put them in a higher tax bracket.

Topics Include:

  • What are the 3 categories of beneficiaries as defined in the SECURE Act for payout options?
  • What is a “back-door” Roth IRA?
  • What are the rules for a Qualified Charitable Exemption (QCD) from an IRA?
  • What proposed rules are in the pending legislation of the “Build Back Better” (Reconciliation Act) that may have a huge effect on IRAs?
